Pulse Pre-Launch Premium Item – Terms & Conditions

These Terms & Conditions (“Terms”) govern the pre-launch premium item offered by AXXESS Malaysia Sdn Bhd (202401051986/1597829-K) (“AXXESS”, “we”, “us”, or “our”) under the Pulse programme to individuals who successfully register for the Pulse pre-launch campaign and make a payment of RM50.00 (“Registrant”, “you”).
By completing the pre-launch registration and payment, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
1. Eligibility & Participation
1.1 The premium item offer is available exclusively to individuals who complete the Pulse pre-launch registration process and successfully pay RM50.00 through the designated payment channel.
1.2 Each registration is entitled to one (1) premium item only, unless expressly stated otherwise.
1.3 The premium item is provided as a pre-launch promotional benefit and does not constitute the sale of goods in the ordinary course of business.
1.4 The RM50.00 payment is made solely for the purchase of the premium item and the associated pre-launch promotional benefits described in these Terms. This payment does not constitute a deposit, reservation fee, advance payment, or prepayment for any telecommunications services, mobile subscription, or Pulse plan. Subscription to Pulse at launch is entirely optional and is not a condition of purchasing the premium item.
As a separate promotional incentive, Registrants who choose to subscribe to an eligible Pulse plan within 30 days of Pulse’s official commercial launch may receive a one-time subscription credit or cashback equivalent to RM50.00, applied to their first bill, subject to applicable campaign terms and conditions in force at the time of subscription.
2. Nature of the Premium Item
2.1 Images, illustrations, descriptions, or specifications of the premium item displayed on the website or marketing materials are for illustrative purposes only.
2.2 The final premium item delivered may differ from the images shown, including but not limited to colour tone, finishing, packaging, branding placement, or minor design variations.
2.3 Such variations shall not be considered defects or grounds for rejection, replacement, or refund, subject to Clause 5.
3. Delivery Timeline
3.1 The premium item will be delivered within two (2) months from the date of successful registration and payment.
3.2 Delivery timelines are estimates only and may be affected by factors beyond AXXESS’s reasonable control, including manufacturing delays, customs clearance, shipping disruptions, force majeure events, or logistical constraints.
3.3 AXXESS shall not be liable for delays in delivery arising from such circumstances.
4. Availability & Substitution
4.1 The premium item is subject to availability.
4.2 If the originally intended premium item becomes unavailable, discontinued, delayed beyond a reasonable period, or cannot be delivered for any reason, AXXESS reserves the right, at its discretion, to:
(a) offer a replacement item of comparable value; or
(b) provide a full refund of RM50.00.

4.3 Where reasonably practicable, AXXESS will seek the Registrant’s preference between a replacement item or a refund.
4.4 No additional compensation, interest, or damages shall be payable beyond the refund of RM50.00.
5. Quality & Manufacturing Disclaimer
5.1 The premium item is sourced from third-party manufacturers and suppliers, including factories located outside Malaysia.
5.2 While AXXESS takes reasonable steps to select reputable suppliers, AXXESS does not manufacture the item and does not provide any warranties, express or implied, as to merchantability, fitness for purpose, durability, or quality beyond what is mandated by applicable law.
5.3 Defect Upon Receipt
If the premium item is received with a material manufacturing defect that renders it unusable or unsafe for its intended purpose, the Registrant must notify AXXESS within seven (7) days of receipt, supported by reasonable evidence (e.g. photographs or videos).
5.4 Subject to verification, AXXESS may, at its discretion:
(a) arrange for a replacement of the defective item; or
(b) provide a refund of RM50.00 if replacement is not reasonably possible.

5.5 Limited Warranty Period
A limited warranty of one (1) month from the date of receipt applies solely to material manufacturing defects. This warranty does not cover:
- Normal wear and tear;
- Cosmetic imperfections;
- Colour, finishing, or design variations;
- Damage caused by misuse, negligence, modification, or improper handling;
- Damage arising from failure to follow usage or care instructions (if any).
5.6 Except for the limited warranty expressly stated above, all other warranties, representations, or conditions, whether express or implied, including warranties of merchantability or fitness for a particular purpose, are expressly disclaimed to the maximum extent permitted by law.
6. No Exchange or Cancellation
6.1 Except as expressly stated in Clause 4, the RM50.00 payment for the premium item is non refundable and non exchangeable.
6.2 Cancellation of registration by the Registrant after successful payment shall not entitle the Registrant to a refund of the RM50.00.
7. Limitation of Liability
7.1 To the fullest extent permitted by law, AXXESS’s total liability in connection with the premium item shall be limited strictly to the refund of RM50.00.
7.2 In no event shall AXXESS be liable for any indirect, incidental, consequential, or special damages, including loss of use, loss of enjoyment, or loss of opportunity.
8. Personal Data
8.1 Personal data collected for the purposes of registration, payment, and delivery of the premium item shall be processed in accordance with AXXESS’s Privacy Policy
9. Amendments & Termination
9.1 AXXESS reserves the right to amend these Terms or withdraw the premium item offer at any time prior to fulfilment, subject to providing a refund of RM50.00 where applicable.
9.2 Any amendments shall take effect upon publication on the Pulse website.
10. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Malaysia. The courts of Malaysia shall have exclusive jurisdiction over any disputes arising from or in connection with these Terms.
